Owner is responsible for sewer, trash, and water. Tenant is responsible for electric, gas, internet, cable.
This Pet Policy Addendum ("Addendum") is incorporated into and forms a part of the Residential Lease Agreement. By and between the Landlord and Tenant(s) for the property listed above, subject to the Montana Residential Landlord and Tenant Act.
1. CONDITIONAL AUTHORIZATION & PRE-APPROVAL
Keeping a pet on the premises is a revocable privilege, not a right. No pet may be brought onto the property until it has been met, evaluated, and explicitly approved in writing by the Landlord. Tenants must provide up-to-date proof of municipal licensing and current rabies vaccinations prior to moving the pet into the residence.
2. RESTRICTED BREEDS AND WEIGHT LIMITS
Due to property management guidelines and insurance liability standards, the following restrictions apply strictly to traditional domestic dogs.
Prohibited Breeds: The following breeds (including full breeds or any mix/lineage thereof) are strictly prohibited from the premises: Pit Bulls (including American Staffordshire Terriers), Rottweilers, Doberman Pinschers, Chow Chows, Wolf-Dog Hybrids, Akitas, Cane Corsos, and Great Danes.
Behavioral Discretion: The Landlord retains absolute discretion to reject any individual dog that exhibits aggressive behavior, excessive barking, or high anxiety during the pre-approval meeting, regardless of its breed or size.
3. FINANCIAL TERMS & NO PET DEPOSIT
No Pet Deposit: The Landlord does not charge an additional pet security deposit or any non-refundable pet fees for authorized animals.
Pet Rent: A recurring monthly fee of $_____0_____ shall be paid as additional rent for the duration of the pet's tenancy.
4. MANDATORY PET LIABILITY INSURANCE REQUIREMENT
Because no pet security deposit is collected, the Tenant is subject to the following mandatory insurance protocols to protect against physical damage and liability:
Required Coverage: The Tenant must secure and maintain a comprehensive Renter’s Insurance policy that includes a dedicated Pet Liability Coverage/Animal Damage Rider with a minimum limit of $100,000 per occurrence.
Coverage Scope: The policy must explicitly cover third-party bodily injury, property damage, and internal structural pet damage (including but not limited to stained carpets, chewed baseboards, door scratches, and subfloor odors) caused by the authorized animal.
Proof of Coverage: The Tenant must provide a Certificate of Insurance listing the Landlord as an "Additional Interest" or "Interested Party" prior to the pet's arrival. The Tenant must provide proof of annual renewal throughout the lease term.
Cancellation Notice: The policy must contain a provision requiring the insurer to provide the Landlord with at least ten (10) days' prior written notice of cancellation or material change in coverage.
5. TENANT LIABILITY AND CLEAN-UP RULES
Full Responsibility: The absence of a pet deposit does not release the Tenant from financial liability. The Tenant remains personally and fully responsible for 100% of repair and remediation costs for any damage caused by the pet that exceeds or is excluded by their insurance policy coverage.
Waste Removal: All pet waste must be picked up immediately and disposed of in designated outdoor trash receptacles. Failure to instantly clear pet waste will result in a $____25______ fine per occurrence.
Control and Noise: Dogs must be kept on a leash at all times when outside the interior walls of the rental unit unless in gated yard. Quiet hours must be strictly observed, and continuous barking or whining that disturbs neighbors constitutes a substantial lease violation.
6. EXEMPTIONS FOR ASSISTANCE ANIMALS
In accordance with the federal Fair Housing Act and Montana law (MCA § 70-24-114), legally qualified Service Animals and Emotional Support Animals (ESAs) are exempt from the pet approval meetings, breed exclusions, weight limits, pet rent, and the specific pet liability insurance mandates outlined in this Addendum. For ESAs, the Landlord reserves the right to request official documentation from a licensed mental health professional who has an established, ongoing professional relationship with the tenant for at least thirty (30) days prior, as required under Montana law (HB 703).
7. VIOLATIONS AND REMEDIES
Any breach of this Addendum (including failure to maintain insurance coverage, introducing an unapproved breed, or repeated waste violations) constitutes a material lease violation. Under Montana law, the Landlord may issue a written notice giving the Tenant three (3) days to remedy the violation or remove the animal. Failure to comply will result in immediate lease termination and eviction proceedings.
This rental does not have dedicated AC units and must be provided by tenant. The landlord has left 3 free standing AC units in the upstairs bedrooms and living room as a convenience for the tenants. If units fail to perform they will not be serviced or replaced by the landlord. No window AC units are allowed. Every room is set up with a 6" vent through the wall to accomodate portable AC units.
No satelite, internet or devices can be attached to the building. No no holes for wires or attachments may be done by tenant to the building. Nothing can be attached to the windows, doors or frames without approval.
1. LAWN CARE AND YARD MAINTENANCE
Tenant agrees to maintain the lawn, landscaping, and exterior grounds of the Premises in a neat, clean, and
healthy condition in compliance with all Montana local city and county ordinances.
• Mowing and Edging: Tenant must mow and edge the lawn at regular intervals to ensure the grass height
does not exceed four (4) inches at any time.
• Watering: Tenant is responsible for watering the lawn, trees, and shrubs sufficiently to keep them alive and
green during the growing season (typically May through September), subject to local municipal water
restrictions. If Sprinkler system does not work the tenant is responsible for notifying the landlord imddediately.
• Weed Control: Tenant must actively manage, pull, or spray weeds in the lawn, flower beds, and sidewalk
cracks to prevent overgrowth.
• Raking and Debris: Tenant must rake and properly dispose of fallen leaves, dead branches, and seasonal
organic debris to maintain a clean appearance.
2. DRIVEWAY AND EXTERIOR MAINTENANCE
Tenant is responsible for keeping the driveway, walkways, and parking areas safe, functional, and clear of
hazards.
• Vehicle Restrictions: No inoperable, unregistered, or uninsured vehicles may be parked or stored on the
driveway or lawn. All vehicles parked on the property must be in functional condition.
• Fluid Leaks: Tenant must keep the driveway free of automotive fluid stains (oil, transmission fluid, coolant).
