Over the past year we experienced persistent, disruptive noise disturbances from the pool and community areas next to our unit, often all day and nearly always late into the night. Some folks in the community categorize them as “ragers” with upwards of 30-50 people drinking and playing unreasonably loud music. We personally documented several of these incidents through written complaints, videos, and direct reports to both TAVA management and their contracted security service, Oculus Security.... Despite this extensive record, management repeatedly failed to act in any way to limit the noise and impact on us personally and others as residents.
TAVA consistently responded with excuses, claiming it was “difficult to identify residents after hours,” “a staffing issue,” “supposed to have pool attendants but didn’t get any”, or “outside normal business hours.” Meanwhile, as a property they should have full access to badge data showing exactly who enters the pool, community center, and grilling areas during these times along with what can be assumed are CC TV in these locations. Even with this information, they rarely followed up & never enforced any of their own rules.
When we became fed up in August, we were advised by management to file a formal lease release without penalty request due to these ongoing disturbances. We did exactly that, submitted detailed documentation, timelines, and evidence, only to have our request ignored for nearly a month after repeated written follow ups. We personally had to visit the Resident Services office multiple times just to get acknowledgment that the request was even reviewed, then had to push to have it escalated to Michelle (Community Manager). When a response finally came on Oct 3rd, our request to terminate the lease without penalty was denied.
To make matters worse, we later learned in a follow conversation that Michelle (Community Manager) falsely noted in our resident file that we were offered a different unit as a “fair resolution” and that we (my wife and I) denied that offer. This is categorically false. At no point were we offered, verbally or in writing, a transfer or alternative unit. It’s prudent to note that we have recorded every in-person conversation with a resident services or leasing agents, and none contain such an offer. Importantly, this false documentation was then used as justification for denying our lease release without penalty and they still would assess us the $2,285 penalty fee.
